What Does the Law Define as a Personal Injury?

Personal injury is a legal term used to describe an injury to the body, mind or emotion of an individual as opposed to an injury to property. The term personal injury arises from its use in civil law and alleges that the plaintiff has been injured by the negligent or intentional acts of another. Personal injury also can result from an invasion of privacy or when one is defamed by another. What is Recoverable in a Personal Injury Lawsuit?

Damages in a civil lawsuit usually comes in the form of money damages and are generally awarded to place a claimant in a position that he would have been in had the defendants conduct not occurred. Damages in a civil lawsuit are quantified under two headings: general damages and special damages. These two types are classified as compensatory damages and are both designed to return the injured to the position they were in prior to the alleged injury.

General damages compensate the claimant for the non-monetary aspects of the harm suffered. Also known as pain and suffering or loss of amenity, general damages (money) and includes past, present and future injuries.

Special Damages on the other hand, compensate the claimant for quantifiable monetary losses that are particular to the specific claimant. For example, if a person was injured in an automobile accident, the victim could seek damages that would cover medical expenses, damage to the motor vehicle, and the loss of earnings now and in the future. Each of these would be classified as special damages which are recoverable if (1) damages can be proved with reasonable certainty, (2) the injury was proximately caused by the defendants conduct and (3) the injury was not a remote result of the defendant’s conduct.
