Bankruptcy Law

Your Bankruptcy Rights in the United States

Andre A. Khansari, Esq. photo Article I, Section 8, of the United States Constitution authorizes Congress to enact "uniform Laws on the subject of Bankruptcies." A fundamental goal of bankruptcy laws enacted by Congress is to give debtors a financial "fresh start" from their burdensome debts. The Supreme Court solidified the purpose of bankruptcy laws in a 1934 decision when it stated:

“[Bankruptcy] gives the honest but unfortunate debtor… a new opportunity in life and a clear field for future effort, unhampered by the pressure and discouragement of preexisting debt.” Local Loan Co. v. Hunt, 292 U.S. 234, 244 (1934). This Congressional goal is accomplished through the bankruptcy discharge process, which releases debtors from personal/business liability from specific debts and prohibits creditors from taking any action against the debtor to collect those debts.

Depending on a business’ or an individual’s financial situation, there are several options in filing for bankruptcy for the debtor i.e. Chapter 7 (Entitled Liquidation), Chapter 11 (Entitled Reorganization), Chapter 13 (Entitled Adjustment of Debts of an Individual with Regular Income).

Don’t let your fears of filing for bankruptcy hinder your ability to protect yourself, your family and your property by either discharging debts and/or your business assets and liabilities so you are profitable again. Whether you are a business owner or an individual who can no longer sustain your current financial obligations because of over-burdensome debt, down economic times, death, injury, or unemployment, the attorneys and legal staff at Khansari Law can help.
